Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the websites, portals, and services (collectively, the "Services") operated by The M!NTed Group LLC (formerly TZ Consulting LLC), doing business as PLACEM!NT ("we," "us," or "our"), including but not limited to placemint.agency and any branded sites or portals for our consulting or recruiting services. By accessing or using the Services, you agree to these Terms. If you do not agree, you may not access or use the Services.
 

1. Definitions

  • Candidate: An individual using the Services to explore, apply to, or be considered for roles.

  • Client: An employer or organization that engages the M!NTed group for recruiting, staffing, or consulting support.

  • Placement: A Candidate's start of employment or engagement with a Client (or the Client's affiliate) resulting from Services.

  • Portal: Any the M!NTed group or third-party system used to provide Services (including application, scheduling, messaging, or e-signature tools).

  • Content: Information, text, files, resumes, communications, recordings, and other materials provided through the Services.

2. Services Description

2.1 Overview

We provide:

  • (a) Consulting services to medspa, wellness, aesthetic medicine, legal, and adjacent businesses; and

  • (b) Recruiting and staffing services for roles in medspa, wellness, aesthetic medicine, legal, and related industries.

2.2 Candidate Services

We may help Candidates discover opportunities, apply for roles, schedule interviews, prepare for interviews, and communicate with Clients. We may also use tools to support matching and workflow (see AI-Assisted Services below).

2.3 Client Services

We may source, screen, coordinate, and support hiring workflows for Clients, including sharing Candidate information with Clients for recruiting purposes.

2.4 No Employment Relationship / No Guarantee

the M!NTed group is not your employer unless expressly stated in a separate written agreement. Using the Services does not guarantee an interview, offer, placement, or any specific outcome.

2.5 No Medical or Clinical Services

Although we work with medspa, wellness, and healthcare-adjacent businesses and roles, we do not provide medical care, clinical services, or medical advice through the Services. Nothing on our websites, in our communications, or in our Services is intended to replace consultation with a qualified healthcare professional.

2.6 No Legal Services or Attorney-Client Relationship

Although we work with law firms, legal departments, and legal professionals, we are not a law firm and do not provide legal services or legal advice. Nothing on our websites, in our communications, or in our Services is intended to create an attorney–client relationship or to replace consultation with a licensed attorney.

3. Candidate Obligations

3.1 Accuracy

You agree to provide accurate, current information (including your resume, experience, and contact details) and to update it if it changes.

3.2 Professional Conduct

You agree to communicate respectfully and comply with Client requirements during recruiting processes. Misrepresentation or abusive conduct may result in limited or terminated access to the Services.

3.3 Sensitive Information

Please do not include highly sensitive information in your resume or submissions (such as social security numbers, full financial account numbers, detailed medical records, or genetic/biometric data), unless we specifically request it for a given role and provide an appropriate secure method.

If you work in a legal role, do not share privileged or confidential client information (such as identifiable client names, specific matter details, or privileged documents) through our Services unless it is strictly necessary, appropriately anonymized, and permitted under your professional and contractual obligations.

3.4 Submissions and Duplicate Applications (Narrow Protection)

If we submit you to a specific Client for a specific role (an "Active Submission"), you agree not to knowingly submit yourself separately to that same Client and role through another recruiter or channel during the Active Submission window. This does not restrict you from pursuing other roles or opportunities.

4. Client Obligations (If You Are a Client)

4.1 Fees and Payment

Client fees, payment terms, and any guarantees (if offered) are governed by a separate written agreement, statement of work, or placement agreement. If a separate agreement does not exist, any fees must be confirmed in writing by the M!NTed group prior to submission or placement.

4.2 Candidate Ownership / Introduction

If the M!NTed group introduces a Candidate to a Client (directly or indirectly) and that Candidate is hired/engaged by the Client (or its affiliates) within an agreed ownership window (set in the Client agreement or confirmed in writing), the placement is attributable to the M!NTed group.

4.3 Replacement / Guarantee

Any replacement or guarantee terms apply only if stated in a separate Client agreement and subject to its conditions.

4.4 Non-Solicitation

Clients agree not to solicit or hire the M!NTed group team members or contractors except as permitted by a separate written agreement.

4.5 Equal Opportunity and Fair Employment Practices

We expect our Clients to comply with applicable equal employment opportunity, anti-discrimination, and anti-harassment laws. We do not knowingly accept job orders or recruiting instructions that require unlawful discrimination.

4.6 Regulated Professions

For Clients in regulated professions (including law and healthcare), Clients remain solely responsible for complying with applicable professional responsibility rules, conflicts-of-interest rules, licensing rules, and other regulatory obligations. Our Services do not include providing legal compliance advice or performing conflicts checks on behalf of Clients.

5. Accounts, Portals, and Acceptable Use

5.1 Account Responsibility

If you create an account, you are responsible for maintaining confidentiality of credentials and for activity under your account.

5.2 Acceptable Use

You agree not to:

  • violate laws or third-party rights;

  • submit false or misleading information;

  • harass, threaten, or abuse others;

  • interfere with security, operations, or availability of the Services;

  • scrape or harvest data from the Services without written permission;

  • upload malware or attempt unauthorized access.

We may suspend or terminate access for violations.

5.3 Third-Party Services

Some Services are provided via third parties (e.g., scheduling, video, e-signature, messaging). Your use of third-party tools may be subject to their terms. We are not responsible for third-party outages or changes.

6. AI-Assisted Services

We may use software and tools, including AI-assisted tools, to help with recruiting workflows (for example: organizing information, summarizing notes, drafting communications, or supporting matching). We do not intend to make final employment decisions solely by automated means through our Services. Where required by applicable law, you may have rights relating to certain forms of automated processing.

7. Interview Recordings (When Used)

Interviews or recruiting conversations may be recorded only when notice is provided and where legally permitted. If recording is offered, we may provide a consent step before recording begins. Recordings, if collected, are handled as described in the Privacy Policy.

8. Background Checks and Screenings

In connection with certain roles, Clients or their background-check providers may conduct screenings (such as employment verification, professional license or bar membership verification, or criminal background checks) in compliance with applicable law. Where required, separate disclosures and authorizations will be provided to you before such checks are performed.

9. SMS / Text Messaging Terms (A2P 10DLC Compliant)

If you provide your phone number and affirmatively opt-in to receive text messages from The M!NTed Group LLC (formerly TZ Consulting LLC), doing business as PLACEM!NT, you agree to these SMS terms:

  • Purpose: Automated recruitment text messages (e.g., application confirmations, interview scheduling, reminders, and job alerts) sent via our communication providers, including Twilio.

  • Opt-In: You will only receive texts if you affirmatively opt in (for example, by checking a box during application). Consent is not a condition of employment.

  • Message Frequency: Message frequency varies based on recruitment activity and application status.

  • Rates: Message and data rates may apply.

  • Opt-Out: Text STOP to opt out at any time. After texting STOP, you will receive one final message confirming you have been unsubscribed.

  • Help: Text HELP for assistance, or email contact@placemint.agency

  • Carriers: Carriers are not liable for delayed or undelivered messages.

  • Compliance: We intend our SMS recruitment program to comply with applicable laws and industry guidelines (including the Telephone Consumer Protection Act (TCPA), applicable state laws, CTIA messaging principles, and Twilio's Messaging Policy and Acceptable Use Policy), and we honor all opt-out requests.

  • Consent Records: We maintain reasonable records of your SMS consent (including date, time, and method of opt-in) as part of our compliance efforts.

  • Use Limitation: We do not use SMS to promote unrelated third-party products or services, and our recruiting messages relate only to opportunities or updates connected to our Services.

10. Data Processing & Technology Partners

To provide efficient recruitment services, the M!NTed group utilizes specific third-party platforms to process your data:

  • Applicant Tracking System (ATS): We use Zoho Recruit to securely store and process your resume, contact information, and application history.

  • Communication Tools: We utilize Twilio to facilitate SMS communications. Only necessary contact details are shared with this provider to execute the service.

  • Privacy Guarantee: We do not sell, rent, or share your personal information or SMS opt-in consent with third parties for their independent marketing or promotional purposes.

11. Intellectual Property

We and our licensors own the Services, branding, and related materials. You may not copy, modify, distribute, or create derivative works except as permitted by law or with our written consent.

You retain rights to Content you submit, subject to the license below.

11.1 License to Use Candidate/Client Content

You grant us a limited, non-exclusive license to host, process, transmit, and display Content solely to provide and improve the Services and to conduct recruiting activities consistent with these Terms and the Privacy Policy.

12. Confidentiality & Equal Opportunity

12.1 Confidentiality

Certain information may be confidential (including Client role details, Candidate information, compensation data, and process notes). You agree not to disclose confidential information except as authorized or required by law.

12.2 Equal Opportunity Employer (Recruiting Services)

the M!NTed group is an equal opportunity employer and recruiter. When providing recruiting and staffing services across all industries we serve (including medspa, wellness, aesthetic medicine, and legal), we evaluate qualified applicants and candidates without regard to race, color, religion, sex, sexual orientation, gender identity, national origin, disability, veteran status, or other legally protected characteristics. We make recruiting decisions based on qualifications, skills, abilities, and business needs.

13. Limitation of Liability

To the maximum extent permitted by law, the M!NTed group and its affiliates will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits/revenue, even if advised of the possibility.

Our total liability for any claim relating to the Services will not exceed the amount you paid us (if any) for the Services in the 12 months before the event giving rise to the claim, or $100 if you paid nothing. (Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the fullest extent permitted.)

14. Indemnification

You agree to indemnify and hold harmless the M!NTed group and its affiliates from claims arising out of your misuse of the Services, violation of these Terms, or violation of law or third-party rights.

15. Dispute Resolution, Venue, and Class Action Waiver

These Terms are governed by Colorado law (without regard to conflict-of-laws rules). Any dispute must be brought in state or federal courts located in Denver County, Colorado, and you consent to that jurisdiction and venue.

To the extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative action.

16. Changes to These Terms

We may update these Terms from time to time. The Effective Date will reflect the latest version. Continued use of the Services after changes means you accept the updated Terms.

This Privacy Policy explains how the M!NTed group collects, uses, shares, and retains personal information when you use our Services.
 

1. Scope

This Policy applies to information we collect through our websites (including but not limited to placemint.agency and any branded sites or portals for our consulting or recruiting services), application experiences, portals, communications, and recruiting workflows. It does not cover third-party sites or services that may be linked or used in connection with the Services, which are governed by their own policies. We process information primarily in the United States. If you access the Services from outside the United States, you understand that your information may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.

2. Information We Collect

2.1 Information You Provide

  • Identifiers & Contact Info: name, email, phone, address (if provided)

  • Application & Employment Info: resume/CV, work history, education, certifications, licenses, bar memberships and jurisdictions (for legal roles), practice areas, references, eligibility/work authorization (as provided), desired compensation, role preferences

  • Communications: emails, texts, chat messages, notes you share, support requests

  • Scheduling/Interview Info: availability, interview feedback you provide, meeting details

  • E-signature / Forms: information and signatures you provide on documents

2.2 Information We Collect Automatically

  • Device/Usage Data: IP address, browser type, pages viewed, timestamps, approximate location (derived from IP), and similar analytics data

  • Cookies/Similar Technologies: used for site functionality and limited measurement

We do not rely on "Do Not Track" signals.

2.3 Information From Others

  • Clients / References: role requirements, feedback, and hiring process updates

  • Service Providers: delivery and status data for scheduling, messaging, and related tools

  • Background Check Providers: In connection with certain roles, Clients or their vendors may conduct employment verifications, professional license or bar membership verifications, or other lawful screenings

  • Public Sources: professional profiles or publicly available information you choose to share publicly (where relevant to recruiting)

3. How We Use Information

We use personal information to:

  • Provide recruiting services (applications, matching, coordination, scheduling)

  • Provide consulting services to medspa, wellness, legal, and adjacent businesses

  • Communicate with you (including via email/phone/SMS when you opt in)

  • Facilitate interviews and share Candidate profiles with Clients (with your participation in a process)

  • Operate, secure, and improve the Services

  • Maintain records and enforce policies

  • Comply with legal obligations and respond to lawful requests

Recruiting-Focused Use: We use Candidate information only for recruiting and employment-related purposes (including related communications), improving our recruiting Services, and complying with legal obligations. We do not sell Candidate information or use it for unrelated third-party marketing.

We may use tools (including AI-assisted tools) to support workflow and communication. We do not intend to make final hiring decisions solely by automated means through our Services.

4. How We Share Information

4.1 With Clients (Potential Employers)

If you apply for or pursue a role with a Client, we may share relevant Candidate information (e.g., resume, application details, interview coordination info) to support the recruiting process.

4.2 With Service Providers

We use vendors to operate the Services (for example: applicant tracking, scheduling, video meetings, e-signature, messaging, analytics, and hosting). These providers process information on our behalf under contractual restrictions.

Examples of service providers may include:

  • ATS / Recruiting platform: Zoho Recruit

  • Scheduling: Calendly

  • Video meetings: Zoom

  • E-signature: Zoho Sign

  • SMS delivery: Twilio

Providers may change over time.

4.3 For Legal and Safety Reasons

We may disclose information if we believe it is reasonably necessary to comply with law, enforce terms, protect rights/safety, prevent fraud, or respond to lawful requests.

4.4 Business Transfers

If we undergo a corporate transaction (e.g., merger, acquisition, asset sale), information may be transferred as part of that transaction.

5. SMS / Text Message Privacy (Operational Recruiting Only)

If you opt in to receive SMS from the M!NTed group:

5.1 What We Collect for SMS

  • phone number

  • opt-in status and related metadata (e.g., date/time and method)

  • message content and delivery status (as needed to provide messaging)

  • opt-out records (e.g., STOP requests)

5.2 How We Use and Share SMS Data

We use SMS to send operational recruiting updates you requested (application/interview updates). We share SMS data with service providers (such as Twilio) to deliver messages.

We do not sell or rent SMS opt-in data, and we do not share your mobile number or SMS opt-in information with third parties for their marketing.

5.3 Opting Out

6. Cookies and Analytics

We may use cookies or similar technologies for:

  • essential site functions (security, session management)

  • limited analytics to understand site performance

You can control cookies through your browser settings. Some site features may not function properly if cookies are disabled.

7. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services and for legitimate business purposes such as maintaining records, resolving disputes, preventing fraud, and complying with legal obligations.

If you no longer wish to be considered for opportunities, you may email us at contact@placemint.agency to request that we limit or delete your Candidate profile, subject to our legal obligations and legitimate business needs (such as maintaining records of placements).

Where we describe timeframes (for example, SMS consent records or message logs), they are general guidelines and may be extended where required by law or for legitimate business needs (such as documenting consent or responding to disputes).

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Your Privacy Rights

Depending on where you live, you may have rights such as access to certain personal information we hold about you, correction of inaccurate information, deletion (subject to exceptions), receiving a copy of information you provided to us, and opting out of certain processing where applicable.

9.1 How to Submit a Request

Email contact@placemint.agency with your request. We may ask for information to verify your identity and protect against unauthorized requests. We will respond within the time required by applicable law.

9.2 Authorized Agents

If applicable law allows an authorized agent to act on your behalf, we may request proof of authorization and identity verification.

10. Children's Privacy

The Services are not intended for children. If you believe a child has provided us information, contact us and we will take appropriate steps consistent with applicable law.

11. Changes to This Policy

We may update this Privacy Policy. The Effective Date indicates when the latest version applies.
